Welcome to PhotoPatcher. These Terms of Use ("Terms") govern your access to and use of the PhotoPatcher mobile application ("App") and related services. By downloading, installing, or using PhotoPatcher, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using PhotoPatcher, you confirm that you:

  • Are at least 13 years of age
  • Have the legal capacity to enter into these Terms
  • Will comply with all applicable laws and regulations
  • Accept our Privacy Policy

If you do not agree to these Terms, do not use the App.

2. Description of Service

PhotoPatcher is an AI-powered photo editing application that allows users to:

  • Edit photos using AI-assisted patching and regional modifications
  • Draw objects that are rendered by AI
  • Add overlay images that are blended using AI
  • Generate and modify images using text prompts

The App processes images using cloud-based AI services and requires an internet connection for most features.

3. User Accounts

Some features require account creation. You are responsible for:

  • Providing accurate account information
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

4. Subscriptions and Payments

4.1 Free and Premium Features

PhotoPatcher offers both free features and premium subscription options. Premium subscriptions provide:

  • Increased generation credits
  • Access to higher-quality AI models
  • Priority processing
  • Additional features as specified in the App

4.2 Billing

Subscriptions are billed through your App Store (iOS) or Google Play (Android) account. Billing terms are governed by the respective platform's policies.

4.3 Cancellation

You may cancel your subscription at any time through your device's subscription management settings. Cancellation takes effect at the end of the current billing period.

4.4 Refunds

Refund requests are handled according to Apple App Store or Google Play Store policies. Contact the respective platform for refund inquiries.

5. Acceptable Use

You agree NOT to use PhotoPatcher to:

  • Create, upload, or share illegal content
  • Generate non-consensual intimate imagery of real people
  • Create content that exploits or harms minors
  • Generate hate speech, harassment, or discriminatory content
  • Create content that infringes on intellectual property rights
  • Impersonate others or create misleading deepfakes
  • Generate content promoting violence or terrorism
  • Violate any applicable laws or regulations
  • Attempt to reverse-engineer, hack, or compromise the service
  • Use automated systems to access the service beyond normal use

6. Content Guidelines

6.1 Your Content

You retain ownership of images you create or edit using PhotoPatcher. However, you grant us a limited license to process your content as necessary to provide the service.

6.2 Content Restrictions

We reserve the right to refuse processing or remove content that violates these Terms, including but not limited to:

  • Explicit adult content (unless permitted by your account tier)
  • Content depicting real individuals without consent
  • Content that could be used for fraud or deception
  • Content that violates applicable laws

6.3 Content Moderation

We may use automated systems and human review to enforce content guidelines. Repeated violations may result in account suspension or termination.

7. Intellectual Property

7.1 Our Property

PhotoPatcher, including its design, features, code, and AI models, is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or attempt to extract source code
  • Use our trademarks without permission
  • Remove any copyright or proprietary notices

7.2 Your Rights

You retain all rights to your original images. For AI-generated content, you receive a license to use the output for personal and commercial purposes, subject to these Terms.

8. Disclaimers

8.1 Service Availability

PhotoPatcher is provided "as is" and "as available." We do not guarantee:

  • Uninterrupted or error-free service
  • Specific results from AI processing
  • Compatibility with all devices or operating systems
  • Permanent availability of any feature

8.2 AI Limitations

AI-generated content may not always meet your expectations. Results depend on various factors including input quality, prompts, and AI model capabilities.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability is limited to the amount you paid us in the past 12 months
  • We are not responsible for content created by users
  • We are not liable for third-party services or platforms

10. Indemnification

You agree to indemnify and hold harmless PhotoPatcher and its affiliates from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your use of the App
  • Content you create or share using the App
  • Your violation of any third-party rights

11. Account Termination

11.1 Our Right to Terminate

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activity
  • Abuse the service or other users
  • Fail to pay for subscriptions

11.2 Your Right to Terminate

You may delete your account at any time by contacting us at [email protected] or through the App settings. Upon account deletion:

  • Your personal data will be deleted within 30 days, as described in our Privacy Policy
  • Your AI-generated content and editing history will be permanently removed from our servers
  • Any unused credits or subscription benefits will be forfeited
  • Active subscriptions must be canceled separately through your App Store or Google Play account to prevent future charges

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through:

  • In-app notifications
  • Email (if you have an account)
  • Updates to this page

Continued use of the App after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction where PhotoPatcher is registered. Disputes will be resolved through binding arbitration, except where prohibited by law.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PhotoPatcher regarding use of the App.
